Chapter 7

Dominic became a problem for everyone.

Not because he threatened Gary.

Because everyone expected him to.

Gary’s lawyer immediately filed a notice alleging that Dominic’s appearance at the house proved Claire and Dominic were colluding to intimidate him.

Dominic’s attorney responded with:

The 911 call.

Doorbell footage.

Phone records.

And Dominic’s own recorded call with Brooke.

When Dominic said:

“Stay away from my children,”

he was already outside the house.

Claire had sent him an emergency message through counsel after realizing Gary had taken Ethan from school without explanation.

Dominic had been nearby for a scheduled meeting with his own attorney.

He came.

His lawyer followed in a separate car.

Dominic called Brooke because the front door was locked and he could hear shouting.

He did not know Gary was beating Ethan until Brooke answered.

Then he entered after Claire remotely unlocked the front door from her phone.

He never struck Gary.

Never touched him.

Never threatened him after police arrived.

That restraint mattered.

Lena asked Dominic privately:

“Did you want to hurt him?”

“Yes.”

“Why didn’t you?”

“My daughter asked me not to make it worse.”

“Would you have listened five years ago?”

Dominic stared at her.

“No.”

It was not a heroic answer.

It was honest.

The family court judge also reviewed Dominic’s position.

His criminal history did not disappear because Gary had abused Ethan.

The judge refused Dominic’s request for immediate expanded custody.

Instead:

Claire retained temporary residential custody under a safety plan.

Gary was barred from the home.

Dominic’s existing structured parenting arrangement remained in place.

Brooke and Ethan received their own guardian ad litem.

An independent evaluator replaced the relocation consultant Gary had previously selected.

Dominic was furious.

“My son was beaten in that house.”

The judge answered:

“And your criminal history remains relevant to placement.”

Dominic’s attorney touched his arm.

He stopped talking.

That moment later became important to Brooke.

Her father, a man everyone feared, had to sit still while a judge told him loving his children did not erase the risks he had created around them.

He did.

Meanwhile, Gary’s electronics were examined under lawful warrants tied to the abuse and suspected false reports.

Investigators found searches about Ohio relocation standards.

Not surprising.

He was involved in a relocation case.

Then they found:

emergency relocation domestic danger burden evidence

credible threat custody move state

anonymous threat admissible family court

Searches were not crimes.

Context mattered.

Then came a draft declaration.

Claire’s name appeared at the top.

The document described her as:

in constant fear from criminal threats associated with Dominic Caruso.

Claire had never written it.

Gary claimed it was a draft prepared for discussion.

Maybe.

Then one paragraph:

My son Ethan has personally observed threatening markings and believes unknown men placed them near our home.

Ethan had never said that.

He had said the opposite.

Gary was not merely trying to move.

He was trying to turn a child’s memory into evidence for the move.
