Chapter 8

Elena made the decisions that could not be undone quietly.

First, she filed for divorce.

Not separation.

Not counseling.

Divorce.

Second, she obtained protective orders against Margaret and Ethan.

Ethan could communicate only through attorneys regarding necessary legal matters.

He was not allowed near Elena’s temporary residence or medical appointments.

Third, Elena formally resigned from every Carter Components role.

Finance director.

Any claimed benefits position.

Any family advisory capacity.

Her resignation specifically disputed the authenticity of any document describing her as plan fiduciary unless her independent counsel confirmed it.

Fourth, she reported the retirement-plan concerns through counsel to the appropriate federal benefits authorities and plan trustee.

Her lawyer reminded her:

“This investigation may examine you too.”

“I know.”

“You signed reports.”

“I know.”

“They may conclude you should have escalated sooner.”

“I know.”

“Still proceeding?”

“Yes.”

Fifth, she authorized an independent forensic review of her own company communications.

No deleting embarrassing messages.

No protecting mistakes because she was the victim of violence.

If she had failed professionally, that would be separated from crimes committed against her.

Sixth, Victor made his own irreversible decision.

Moretti Freight had a $5 million secured commercial loan outstanding to Carter Components from the plant expansion.

Victor could have declared default immediately.

Doing so might have destroyed the company and hundreds of jobs.

Instead, he transferred all decisions concerning the loan to an independent restructuring firm.

He told Elena:

“I am too angry to make business decisions about these people.”

She stared at him.

“You’re admitting that?”

“I’m old enough to know what anger costs.”

The restructuring firm agreed to temporary forbearance conditioned on outside management and financial transparency.

Carter Components remained open.

Finally, Elena moved into a small rental near the hospital rather than Victor’s estate.

He hated that.

“You have twenty empty rooms at my house.”

“I know.”

“You’d be safer.”

“I have security.”

“You have one door between you and the street.”

“Dad.”

Victor stopped.

Elena continued:

“I left one controlling family. I’m not moving into another one because yours loves me.”

That hurt him.

He nodded anyway.

May you like

“Fair.”

For the first time in weeks, Elena slept somewhere no Carter possessed a key and no Moretti decided the rules.
