Chapter 22 - Elara’s role is challenged

Vesper’s civil suit attacked Elara’s records.
She hired forensic accountant to review Compliance Deposit 14-C.
Findings:
Several of Elara’s estimates overstated potential improper amounts because she lacked later documentation.
Example:
One $63,000 Greencrest rebate Elara flagged as potentially diverted was ultimately shown as legitimate separate consulting compensation unrelated to a Marlowe invoice, though still undisclosed conflict.
One foundation travel amount double-counted hotel value.
One North Vale payment had been attributed to wrong quarter.
Total corrections reduced some flagged exposure.
Vesper’s lawyer declared:
“Elara’s dossier was unreliable.”
That was too broad.
But Elara was not infallible.
The special committee amended its report.
Why?
Accuracy.
Not worship.
Then Vesper argued contingent inheritance restriction was based on Elara’s “false accusations” and should be disregarded if I died.
Gideon responded:
The restriction did not name Vesper as guilty.
It required independent conflict review for any family insider seeking authority.
Valid regardless of one accounting estimate.
No fake document.
No paternity issue.
No secret cancellation.
Then probate counsel confirmed:
Isolde’s beneficiary position remained unchanged.
Vesper’s lawsuit could not rewrite my estate plan.
Then one narrow issue:
Elara had asked Gideon to retain corporate copies.
Could she legally authorize disclosure of every copied record after death?
Outside counsel divided materials:
Lawfully possessed and nonprivileged.
Privileged screened.
Personal confidential material protected.
Some records excluded from litigation use until court ruled.
No magic “dead wife file beats discovery.”
Then judge held:
Most business records independently obtained from company/vendors were admissible regardless of Elara’s copies.
So even if her packet had defects, investigation now stood on original sources.
Vesper lost the biggest suppression argument.
But she won protection over certain private correspondence.

Mixed.
Primary damages case remained.
