Chapter 19 - Vivian’s criminal case

The criminal case took thirteen months.

No kidnapping-across-state-lines charge.

No trafficking.

No attempted murder.

The strongest counts involved:

Unlawful imprisonment of a child.

Child endangerment.

Custodial interference connected to the court-supervised placement arrangement.

Coercive conduct surrounding food and the attempted recorded statement.

Vivian had no prior criminal record.

Nora had no lasting physical injury.

The confinement lasted roughly sixty-one hours from unauthorized retention to rescue, with the service-corridor confinement forming the most serious portion.

Vivian ultimately entered a negotiated guilty plea to:

One felony-level child-endangerment/unlawful-imprisonment offense.

One misdemeanor custodial-interference offense.

Other charges dismissed.

Sentence:

Four months county custody.

Three years probation.

No direct contact with Nora absent court and therapist approval.

No unsupervised caregiving of unrelated minors during supervision.

Behavioral treatment focused on coercive control, boundaries, and child development.

Restitution for Nora’s therapy and medical expenses attributable to the incident.

Community service after release.

At sentencing, Vivian said:

“I believed Nora belonged with family.”

The judge answered:

“She was with family.”

There.

“Marlene Ellis is her family. Paige is her family. Your disagreement with their decisions did not convert the child into your property.”

Vivian cried.

Then admitted:

“I locked the door.”

There.

“I told her she could come out when she stopped lying.”

There.

“I understand now that I meant when she agreed with me.”

There.

That was probably the most important sentence she ever said.
