Chapter 19 - The verdict

The jury did not convict every charge.

They found Diane guilty of:

Child endangerment.

Unlawful restraint.

Misdemeanor assault related to forceful gripping.

A degrading-treatment/food-related misdemeanor count.

They acquitted one broader felony assault count because prosecution did not prove beyond reasonable doubt that the chain use created the level of physical injury or dangerous force required by that statute.

They also acquitted a separate count tied to one leg bruise because causation was uncertain.

Mixed.

No exaggeration.

Then Diane stared at Daniel.

Not me.

He looked down.

Sentencing later.

She remained under no-contact order.

No dramatic handcuffs in front of cameras beyond normal post-verdict processing.

Then ClearPath.

Licensing board findings arrived shortly afterward.

Marjorie:

Failed to verify legal parental consent.

Failed to maintain appropriate boundaries between coaching and clinical behavioral assessment.

Failed to respond adequately to accumulating warning signs.

Did not authorize abuse.

No finding she knew chain was used around Noah’s neck before police involvement.

Sanction:

Six-month license suspension stayed? Better probationary discipline:

Professional reprimand.

Eighteen months supervised practice/compliance monitoring.

Mandatory ethics/mandated-reporting training.

ClearPath barred from direct minor observation until consent systems approved.

No license revocation.

Marjorie accepted.

She later dissolved ClearPath? Could continue. Better business restructured under independent clinical director.

Then Little Oaks.

Fine:

$42,000? Childcare administrative penalties could vary. Better modest:

$18,500 civil administrative penalty plus corrective action plan.

Susan Patel resigned.

Maya completed revised mandated-reporting training and remained.

I did not remove Noah immediately?

Actually we had moved him to another preschool after incident.

May you like

Yes.

Little Oaks was no longer his school.
