Chapter 10 - The equity fiction

The deeper mechanism became clear after two weeks of forensic accounting.

Delphine had not acquired ownership.

She had been building a fiction of ownership.

First:

Our valid marital agreement allowed reimbursement for approved renovation expenses.

Second:

Maison Vale Studio paid selected vendors first.

Third:

The household reimbursed Maison Vale.

Fourth:

Delphine’s internal spreadsheets continued listing the gross vendor amount as her “capital contribution,” ignoring reimbursement.

Fifth:

In several cases Maison Vale submitted inflated invoices or undisclosed markups, increasing the gross number further.

Sixth:

Delphine created internal memoranda describing those gross figures as “equity participation.”

Seventh:

She inserted my genuine signature image from unrelated reimbursement approvals into at least one memorandum.

Eighth:

She showed those memoranda to her accountant, designer, and eventually a private mediator she had consulted about “protecting her investment.”

No title changed.

No deed recorded.

No mortgage granted.

No lien perfected.

No legitimate 18.5% interest existed.

But why create the file?

Leverage.

If our marriage deteriorated, Delphine planned to argue:

She had contributed over $1.7 million.

I had acknowledged an equity percentage.

Her company had enhanced the property’s value.

Therefore forcing her out without a large settlement would be inequitable.

Would the argument win?

Not as ownership.

But litigation can be expensive.

Constructive-trust and equitable reimbursement theories can create uncertainty depending facts.

She wanted uncertainty.

The threat at the pool:

“Throw me out, and she loses this house.”

was not technically a claim she could execute.

It was pressure.

She believed I would pay heavily rather than risk a public property fight.

Then Maribel.

Delphine’s interior plans systematically moved child spaces away from the home’s most valuable entertaining rooms.

She wanted photographs, floor plans, and usage history showing the residence functioned as:

Our adult marital home improved by her capital contributions.

Not a premarital family residence centered around Maribel.

Presley’s role was not part of the financial fraud.

She was a child absorbing Delphine’s worldview.

But the pool incident exposed how far that worldview had traveled.

My daughter’s bedroom had become a line item in someone else’s negotiating strategy.

That was the point at which reconciliation became impossible.
