Chapter 18 - North Vale’s failures

Independent review found:

The facility appropriately treated Vivienne’s injuries.

It failed in another way.

As her cognition improved, the facility continued relying too heavily on a family liaison who was not actually family.

Vivienne should have been offered:

Independent legal advocacy.

Fresh identity verification.

Clearer review of whether confidentiality arrangements remained voluntary.

Instead, staff treated the Cross representatives as established trusted contacts.

Why?

Because bills were paid.

Documents looked professional.

No one appeared to be physically coercing Vivienne.

That is how respectable systems can prolong harm without intending it.

North Vale later agreed to:

Policy changes.

Independent-patient advocate review for long-term confidential identities.

Periodic re-verification of consent.

External ombuds access.

A civil settlement with Vivienne.

No admission that it imprisoned her.

Because it had not.
