Chapter 12 - The Trust

The Belladonna Heritage Trust had been created by my grandmother in 2004.

After Antonio died.

Important.

Teresa had no role.

The trust held:

Thirty-one percent of Belladonna Real Estate LLC.

A minority interest in Moretti Hospitality.

Several legacy art and property assets.

Its beneficiaries were defined as:

the living biological and legally adopted descendants of Antonio Moretti, subject to proof satisfactory to the trustee.

At creation, everyone believed I was Antonio’s only child.

Teresa knew otherwise.

Said nothing.

Because Isabella was thirteen.

Because Lorenzo was still alive.

Because fear.

Again.

The trust distributed income annually but retained most principal.

Over the previous eight years, distributions attributable to Antonio’s descendant class averaged roughly $650,000 per year before tax.

All went to me.

If Isabella qualified as a descendant, she might have been entitled to a share.

Did that mean I stole her money?

No.

I did not know she existed.

Trustee did not know.

Could there be an adjustment?

Yes.

Independent trust counsel calculated a preliminary range.

Past missed distributions plus investment return:

Approximately $2.6 to $3.1 million before taxes and expenses.

Large.

Not billionaire inheritance.

The trust itself had sufficient liquidity and reserves to correct without me writing a personal check.

I offered anyway.

Trust counsel said:

“Don’t.”

I was learning to hear that word.

Why not?

Because beneficiary adjustments should be handled by trustee under instrument and court approval if necessary.

Not by guilty brother.

That distinction protected Isabella.

If I paid personally, the money could look like a settlement for silence.

She deserved recognized rights.

Not generosity.

Vivian’s proposed restructuring would not have stolen Isabella’s interest automatically.

Important.

If completed without knowledge, it could have complicated notice, accounting, and governance.

Once Vivian suspected Isabella might exist, continuing without disclosure became much more problematic.

Her internal message to counsel:

Need Belladonna modification completed before wedding. Do not reopen historical descendant questions absent formal claimant.

Formal claimant.

Technically cautious.

Then another message to her private adviser:

If Romano is who I think she is, delay kills the deal.

That was motive.

Not murder.

Money and control.

May you like

Enough.
