Chapter 17 - Northbridge settles

Northbridge and its insurer entered mediation with:

Sophie’s court-appointed representative.

Me in limited derivative capacity.

The trustee did not steal.

It failed to catch fraud.

Settlement:

Northbridge restored:

$390,000

to Sophie’s trust from its insurer and corporate funds, representing a negotiated portion of loss attributable to control failures.

It waived:

$85,000

in trustee fees over future period.

Implemented reforms.

Why not full $612,000?

Because Elena remained primarily liable.

Some loss was caused by sophisticated forged documentation.

Some expenses had mixed legitimacy.

Allocation negotiated.

No double recovery.

Any restitution later paid by Elena would first satisfy unrecovered loss and reimburse settling parties according to agreement.

Trust value remained healthy.

Sophie’s future was not financially ruined.

That mattered.
