Chapter 12 - The assault cases

Police reviewed three physical acts.

Wesley:

Kicked table toward me.

Raised hand.

I restrained him.

Augusto:

Slapped Wesley.

Could my restraint be assault?

Video showed Wesley raised his hand and moved toward me immediately after kicking the table.

My response stopped when he was controlled.

Prosecutor declined charge based on defense-of-self circumstances.

Wesley faced:

Misdemeanor assault/endangerment related to the table kick and threatening movement toward a visibly pregnant spouse.

No severe injury.

No felony fetal-harm fantasy.

Augusto:

One slap after immediate danger passed.

He accepted misdemeanor diversion.

Anger-management class.

Community service.

No new offense.

My father hated attending class.

He attended every session.

One evening he told me:

“Apparently intimidation is not conflict resolution.”

“Groundbreaking.”

He glared.

Then smiled.

Progress.
