Chapter 19 - The assault plea

Wesley resolved the physical case first.

Plea:

Misdemeanor assault.

No contest to pregnancy-related endangerment enhancement? Better just sentencing factor.

Sentence:

Eighteen months probation.

Forty hours community service.

Batterer intervention program.

No contact with me except through counsel and required financial proceedings.

No firearm possession while order active if applicable. Avoid jurisdiction details.

No jail.

Why?

No prior record.

No physical contact actually landed on me.

No injury.

But table kick and raised hand established threatening conduct.

The judge said:

“Pregnancy does not make a spouse property requiring obedience.”

Wesley looked down.

He had once said exactly the opposite without using those words.
