Chapter 16 - The criminal charges expand

Prosecutors charged Lenora with:
Scheme to defraud the company benefit program.
Falsifying business records.
Identity-related misuse involving Oliver’s dependent profile.
Misdemeanor child endangerment from the hospital.
Misdemeanor assault.
No charge for “stealing inheritance.”
There was none.
No charge for stealing $318,460 in full.
Because some underlying expenses could legally have been approved for Lucas.
The prosecution focused on the portion obtained through false coding and exceeded authority.
Defense argued:
Lenora had broad board-chair discretion.
The company routinely approved exceptions informally.
No employee personally lost money.
Lucas was a family member.
The payments furthered family-support goals.
The coding was an administrative shortcut.
That was not a ridiculous defense.
Mercer Commercial Group had sloppy governance.
Family companies often do.
Then prosecutors showed:
Altered names.
The replacement-dependent note.
Instructions to keep payments away from Audrey’s cap.
