Chapter 15 - Claire files for temporary custody modification

Claire’s attorney filed an emergency motion.

I knew beforehand.

I did not oppose temporary primary physical custody.

The court still held a hearing.

Because parental rights are not casually rearranged by agreement when serious safety concerns exist.

Claire argued:

Adrian delegated excessive caregiving authority to Vanessa.

Adrian was frequently absent for work.

Household staff failed to report concerns.

Noah needed stability away from the residence while investigations continued.

My attorney responded:

Adrian discovered the incident, immediately removed Noah, called police, cooperated, ended Vanessa’s access, and implemented safeguards.

Both true.

The judge issued a temporary order.

Noah primarily with Claire for eight weeks.

My parenting time:

Frequent daytime periods.

Then overnights after the residence safety plan was verified.

No Vanessa contact.

Independent caregiver approval.

Claire and I both required to exchange names of nonparent caregivers.

I hated losing nights.

Not because Claire was wrong.

Because I had been the weekday parent.

The quiet bedrooms became punishment again.

One evening Noah left my house at seven.

He said:

“Daddy come Mommy?”

“No. You sleep at Mommy’s tonight.”

“Why?”

I could not explain court orders.

“Because grown-ups are making sure your houses feel safe.”

He frowned.

“Daddy house safe.”

I smiled painfully.

“It will be.”

He hugged me.

Then left.

That was consequence.

Not because I put him in the cage.

Because I had failed to see the environment forming around him.

Family court is allowed to care about that distinction and still act.
