Chapter 19 - Octavia’s financial charge

Prosecutors eventually charged Octavia with one felony fraud count tied specifically to the Halberd investment.

Not:

Stealing $38 million.

She had not.

Not:

Forging Victor’s will.

There was no will involved.

Not:

Trying to steal Betsy’s inheritance.

Again, wrong mechanism.

Charge theory:

She knowingly used a falsified founder-succession memorandum as a material representation to secure investment terms benefiting her partnership.

Defense argued:

Halberd would have invested anyway.

Potentially relevant to damages.

Less persuasive on whether representation was false.

The case moved toward trial.

Then settlement discussions began.
