Chapter 12 - Grandpa’s Kick and Grandpa’s Foot

Grandpa’s legal analysis split into two parts.
The kick:
Valerie had a bat raised.
I was shielding a baby.
Immediate danger.
Defense of others.
The foot:
Valerie was already on the ground.
The bat was away.
He stepped down deliberately.
Retaliation.
The words:
“Now it’s your turn to pay”
made intent obvious.
Grandpa accepted a misdemeanor resolution.
Probation.
Anger-management counseling.
Community service.
No unlawful contact with Valerie.
He complained constantly.
His counselor apparently asked:
“Why did you want her to pay?”
Grandpa answered:
“Because she hurt my grandsons.”
“Were they safe when you stepped on her?”
“Yes.”
“Then paying was your goal, not protecting.”
Grandpa told me:
“I dislike that man.”
“Because he’s wrong?”
May you like
“No.”
That was progress.
