Chapter 17 - The kidnapping trial begins

Vivian rejected a plea.
Prosecution had offered:
Plea to kidnapping/unlawful confinement plus fraud-related count.
Substantial prison recommendation below trial maximum.
She refused.
Why?
She insisted original motive was protection.
Trial began fourteen months after Nora was found.
Nora did not sit in courtroom every day.
A child advocacy attorney represented her interests.
Forensic interview evidence handled under applicable rules.
She testified only through legally appropriate procedure when necessary, with accommodations authorized by court.
No theatrical confrontation.
Prosecution opened with timeline.
8:14 a.m.:
Vivian leaves Rachel’s apartment with Nora.
9:17:
Phone at Carter residence.
11:52:
911 call from Maple Creek Park.
Then hidden-room construction six weeks earlier.
Then bank records.
Then Dean.
Then Rachel recordings.
Defense:
Rachel’s brain injury.
Family conflict.
Vivian genuinely feared Rachel would flee.
Then they introduced Rachel email:
Sometimes I think I should take Nora and disappear somewhere nobody can find us.
That helped Vivian.
Rachel had written it to a friend during custody frustration.
Did she mean literal abduction?
Friend testified:
“She was venting.”
Still evidence.
Then another email:
Rachel:
Vivian will never let me have my own daughter back.
Both sides had words.
Then construction.
Defense said secure room originally intended for valuables and storm shelter.
Contractor could not prove child use planned before disappearance.
True.
Timing suspicious.
Not conclusive alone.
Then park staging.
Harder.
Vivian admitted lying about location because she panicked.
Her explanation:
Rachel had secretly asked her to take Nora; Vivian invented park story to protect Rachel.

No evidence Rachel asked.
The jury would decide.
