Chapter 7 - Vivian’s first defense

Vivian’s lawyer, Claire Benton, released a statement.
Vivian denied kidnapping Nora.
Claim:
Rachel asked Vivian to take Nora temporarily because Rachel feared losing custody during renewed medical problems.
Vivian kept Nora hidden because Rachel believed “dangerous financial actors” connected to Hawthorne were watching them.
After Rachel died, Vivian became frightened that revealing Nora would expose the concealment and lead to Nora entering foster care.
She continued hiding her out of “misguided protective attachment.”
That defense admitted almost everything except original abduction.
Could Rachel have asked Vivian to hide Nora?
We looked for evidence.
No note.
No email.
No attorney communication.
No recording.
Instead:
Rachel reported Nora missing.
Called police repeatedly.
Distributed flyers.
Appeared on local news.
Spent personal money on private investigator.
Kept Nora’s room unchanged.
That was inconsistent with voluntarily hiding her.
Then one bank withdrawal.
Rachel paid private investigator:
$18,000 over ten months.
Not behavior of a mother secretly aware where her child was.
Then Vivian argued Rachel’s brain injury made her unpredictable.
Medical records:
Rachel had occasional memory gaps.
Depression.
Anxiety.
But her treatment team documented steady improvement.
Six weeks before Nora disappeared, an independent evaluator supported expanded parenting time.
Then Vivian’s guardianship was likely ending.
Motive.
Still:
Why not simply continue billing fraud after Rachel ended Crestview?
Because Hawthorne had started audit.
Then timeline:
Rachel sent Hawthorne formal dispute.
Fourteen days later:
Crestview stopped billing.
Six days later:
Vivian’s consulting payments stopped.
Three weeks later:
Nora disappeared.
The fraud was ending already.
Kidnapping could not preserve future billing for long.
So there had to be another reason.
Hale said:
“Control, retaliation, and exposure don’t always require a continuing revenue stream.”
Maybe.
Then Rachel’s evidence cache.
Not fully reviewed yet.
One item mentioned:
July 18 handoff. Nora heard Dean and Vivian.
Nora was two.
Could a two-year-old be useful witness?
May you like
Not to complex billing.
But perhaps she saw something else.
