Chapter 5 - Rachel’s first recording

Rachel began recording conversations after her attorney advised her to document threats if lawful in the jurisdiction.
Some recordings were made with another participant’s consent? To avoid state law complexity, Rachel used voicemail and in-person recordings made in a jurisdiction permitting one-party consent at the time. Hale confirmed prosecutors would litigate admissibility individually.
The first recording Hale played did not mention kidnapping.
Rachel:
“I’m ending Crestview.”
Vivian:
“You don’t understand what you’re doing.”
Rachel:
“They billed for nights nobody was here.”
Vivian:
“Then dispute those entries.”
Rachel:
“You were paid by them.”
Silence.
Vivian:
“I did consulting.”
Rachel:
“You never told me.”
Vivian:
“I didn’t manage your settlement.”
Rachel:
“You managed everything.”
Then Nora’s name.
Rachel:
“And I’m taking Nora home after the hearing.”
Vivian:
“You are not ready.”
Rachel:
“That’s not your decision.”
Vivian:
“I’m the one who kept her stable while you learned how to walk again.”
Rachel:
“And I’m grateful. That doesn’t make her yours.”
The recording ended.
No threat yet.
Then another voicemail from Vivian to Rachel.
“Stop accusing people before you understand the contracts. You are going to make this worse for yourself.”
Threatening tone.
But ambiguous.
Then Rachel’s attorney notes.
Rachel reported Vivian said privately:
“If you keep Nora, you lose every bit of help you still have.”
Did attorney hear it?
No.
Only Rachel’s report.
Then the recording from police station:
“If anything happens to me… Vivian threatened me because I was keeping Nora.”
What did “keeping Nora” mean?
Rachel had reached the stage of custody transition where Nora stayed with her several nights each week.
Vivian wanted those visits stopped.
Why?
At first I assumed emotional attachment.
Then Hale showed me a Hawthorne reimbursement entry dated the same week.
Crestview overnight family-support aide: 12 hours.
Location:
Rachel’s apartment.
But Rachel had told her attorney:
No aide was present.
Instead Nora stayed overnight.
If Rachel regained Nora and took full control of her own home schedule, false care invoices became harder to hide.
Custody and billing were connected.
May you like
Not because Nora’s money funded the scheme.
Because Rachel becoming independent threatened it.
