Chapter 25 - Nora’s case against Vivian

Nora’s civil case settled after asset hearing.

Vivian’s mother produced evidence of actual loan:

$180,000 advanced years earlier.

Bank wires.

Promissory note.

So not all $310,000 fraudulent transfer.

Accrued interest under note:

Approximately $24,000.

Legitimate repayment around:

$204,000.

Remaining:

$106,000 lacked basis and was returned to Vivian’s account under court order, then remained available to creditors/settlement.

Mixed.

Again.

Then civil settlement.

Vivian agreed to:

$1.25 million judgment/settlement contribution from nonexempt assets and future payment schedule, subject to credits and collectability.

No insurer paid intentional confinement damages.

Rachel’s estate resolved separate claims from Vivian for:

$350,000

from remaining assets/payment plan.

These numbers did not leave Vivian destitute by fiction.

Her available assets were limited.

Judgments could remain partially unpaid.

Nora’s future treatment costs also supported through victim compensation and other settlements.

Then the house.

I sold Carter residence.

Why?

Not because walls were cursed.

Because every mechanical noise woke Nora.

Ellie asked:

“New house have vents?”

“Yes.”

“Girls?”

“Only people we invite.”

Nora smiled faintly.

We moved to a smaller property near her school and therapist.

The old house buyer received full disclosure of structural modifications as required.
