Chapter 13 - Brian’s assault case

The prosecutor reviewed the birthday fight.

Brian:

Raised fist.

Lunged.

Video partly corroborated.

I blocked and struck.

My force stopped after he fell against table.

The prosecutor declined to charge me based on self-defense evidence.

The thrown dog bowl was separate.

Could that be offensive contact?

Yes.

Brian did not seek prosecution on that piece independently, and the state declined to pursue a minor battery allegation in context.

I did not celebrate.

Throwing dog food at someone was childish.

Brian received a misdemeanor assault charge for attempting to strike me.

He entered pretrial diversion.

Anger-management class.

No contact with me except through agreed family communication for sixty days.

No conviction if completed.

No jail.

No dramatic felony for a single failed punch.

Brian told Melissa:

“Dad got me arrested.”

No.

Brian swung.

The state responded.

Language matters.
